Welcome to The Scalpers Journal. These Terms of Service ("Terms") govern your access to and use of The Scalpers Journal, including the website at scalpersjournal.com and all related applications, features, and services (collectively, the "Service"). The Service is operated by the team behind The Scalpers Journal ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
The Scalpers Journal is a trading journal for self-directed traders. You upload CSV exports of your own trade history from supported brokers (currently Robinhood, Charles Schwab, and Interactive Brokers), and the Service parses those CSVs to produce analytics, charts, journals, and other tools to help you review your own trading.
The Scalpers Journal does not connect to your brokerage account, does not place trades on your behalf, and does not have any access to your broker credentials or funds. Everything we do is based on the data you upload.
The Scalpers Journal is not a financial advisor. Nothing in the Service is investment advice, a recommendation to buy or sell any security, or a solicitation for any financial product. The Service is a journaling and analytics tool — what you do with that information is entirely your own decision and your own responsibility. Trading involves substantial risk of loss. Past performance shown in the Service does not predict future results.
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us at support@scalpersjournal.com immediately. We are not liable for losses arising from unauthorized use of your account that you fail to report.
One account per person. You may not share your account with others, sell access to it, or use automated tools to access the Service except as we explicitly permit.
The Service is offered on a paid subscription basis. Current pricing is shown on scalpersjournal.com and may change with notice for new subscribers; existing subscribers will be grandfathered into their existing rate as long as their subscription remains continuously active.
Subscriptions are billed in advance, monthly or annually depending on the plan you choose, and automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel anytime from your account settings or by emailing support@scalpersjournal.com. Cancellation stops future renewals; you'll keep access until the end of your current paid period.
Payments are processed by Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method for the subscription fee, applicable taxes, and any other charges you incur in connection with your account.
We offer a 7-day refund window on new subscriptions, no questions asked. If the Service isn't right for you in your first seven days after first subscribing, email support@scalpersjournal.com and we'll refund you in full. See our Refund Policy for full details.
"Your Content" means anything you upload, type, or otherwise submit to the Service — including CSV files, journal entries, trade notes, tags, settings, reviews, and feedback.
You own Your Content. By submitting Your Content to the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display Your Content solely to operate and improve the Service for you. We don't sell Your Content, we don't use it to train AI models, and we don't share it with third parties except as described in our Privacy Policy.
You are responsible for Your Content. You represent that you have the right to submit it, and that it doesn't violate any law or any third party's rights.
If you submit a review of the Service through the in-app review system, you agree that:

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice, and with or without a refund depending on circumstances.
We work hard to keep the Service running, but we don't guarantee uninterrupted access. The Service may be unavailable due to maintenance, technical issues, third-party outages (Supabase, Netlify, Stripe), or other reasons outside our control. We aren't liable for losses you incur during downtime.
We may add, change, or remove features over time. We'll do our best to give meaningful notice of changes that materially reduce the Service's functionality.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be error-free, secure, or always accurate. The analytics, P&L calculations, and other outputs are based on the CSV data you provide and are intended as a tool for self-review — not as a system of record for tax, accounting, or legal purposes. Always reconcile with your broker's official statements before making any decision that depends on accuracy.
To the maximum extent permitted by law, in no event will we (or our owners, employees, contractors, or affiliates) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost trading opportunities, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
Some jurisdictions don't allow the exclusion of certain warranties or limitations on certain damages. If those laws apply to you, some of the above may not apply, and you may have additional rights.
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms or any applicable law.
You may cancel your subscription at any time. When your subscription ends, your access to paid features is paused, but your data is retained — your trades, journal entries, and notes remain safely stored so you can pick up where you left off if you resubscribe, and you may still export your data. We do not delete your data merely because your subscription has lapsed. We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ends, but provisions that by their nature should survive (e.g., ownership, disclaimers, limitations of liability, indemnification, governing law) will survive.
You may permanently delete your account and all of your data at any time using the "Delete My Account" option in Settings, or by emailing support@scalpersjournal.com. Account deletion immediately removes your trades, journal entries, notes, settings, and reviews from our active database. Some information may persist in encrypted backups for up to 90 days before being purged.
We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the Service before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts.
You agree that any claim must be brought within one year after the cause of action arises, or it is permanently barred.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them freely.
